Terms of Use

These Terms of Use ("Terms") form a binding agreement between you and Advisory Apps Sdn Bhd (Kuala Lumpur, Malaysia). By installing, accessing, or using the PartyPot mobile app or the website at partypotapp.com, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

The PartyPot Service is operated by Advisory Apps Sdn Bhd, a private limited company based in Kuala Lumpur, Malaysia. In these Terms, "we", "us", and "our" mean Advisory Apps Sdn Bhd. You can reach us at hello@partypotapp.com.

PartyPot is a digital ledger and score-keeping tool for in-person social games. It helps players track virtual chips, scores, and transactions among themselves.

PartyPot does not hold, transfer, or process real money. It is not a gambling service, not a payment service, and not a financial institution. Any real-world settlement between players happens outside the app, between those players.

You must be at least 17 years old to use PartyPot. By using the Service, you represent that you meet this age requirement and that you have the legal capacity to enter into a binding contract in your jurisdiction.

You can sign in to PartyPot with Apple, Google, Facebook, or an email and password. You are responsible for keeping your credentials confidential and for all activity under your account. Notify us immediately at hello@partypotapp.com if you suspect unauthorised access.

We may suspend or terminate accounts that breach these Terms, abuse the Service, or pose a security risk.

You agree not to:

• use PartyPot for illegal gambling or any scheme that transfers real money through the app;
• upload unlawful, defamatory, harassing, hateful, or infringing content, including in player names, game names, or notes;
• reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the app, except to the limited extent permitted by applicable law;
• interfere with or disrupt the Service, its servers, or its networks;
• use automated scripts, scrapers, or bots with the Service;
• resell, sublicense, or commercially exploit the Service without our prior written permission.

You retain ownership of the content you create in PartyPot (for example, game names, player names, and notes). You grant us a worldwide, non-exclusive, royalty-free licence to host, display, back-up, and process that content solely to operate and improve the Service.

You represent that your content does not infringe any third party's rights and does not violate applicable law. We reserve the right — but have no obligation — to remove content that breaches these Terms or applicable law.

PartyPot is free today. In the future we may offer paid features as one-time purchases or subscriptions via the Apple App Store or Google Play.

• All payments are processed by Apple or Google under their terms. We do not receive your payment-card details.
• Refunds are governed by Apple's or Google's respective refund policies — please contact them directly for refund requests.
• Auto-renewal: subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period, in your Apple ID or Google Play account settings.
• Price changes: we will give reasonable prior notice before any price increase on an existing subscription.

PartyPot integrates third-party services including Firebase (Google), Apple Sign-In, Google Sign-In, Facebook Login, Google AdMob, and Meta Audience Network. Your use of features provided by those third parties is also subject to their respective terms and privacy policies.

The PartyPot name, logo, app interface, source code, content, and all underlying intellectual property belong to Advisory Apps Sdn Bhd or its licensors. We grant you a limited, revocable, non-transferable, non-exclusive licence to use PartyPot for personal, non-commercial use in accordance with these Terms.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

We do not guarantee that data in your account will always be available. We run regular backups, but you are responsible for retaining any records you consider critical outside PartyPot.

To the fullest extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the twelve (12) months before the claim or (b) USD 50.

We will not be liable for any indirect, consequential, incidental, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, even if we have been advised of the possibility of such damages.

Nothing in these Terms excludes or limits our liability where that liability cannot be excluded or limited under applicable law, including applicable consumer protection law.

You agree to indemnify and hold harmless Advisory Apps Sdn Bhd, its officers, directors, and employees against any claim, loss, or expense (including reasonable legal fees) arising out of your misuse of the Service, your breach of these Terms, or your violation of any law or any third-party right.

These Terms apply while you use the Service. You may stop using PartyPot at any time by deleting your account — either from inside the app or by emailing us. We may suspend or terminate your access with or without notice if we reasonably believe you have breached these Terms or applicable law, or to protect the Service and its users. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.

We may update these Terms from time to time. The "Last updated" date at the top of the page will reflect the most recent revision. For material changes we will provide additional notice (for example, an in-app notice or an email to account holders). Your continued use of the Service after the revised Terms take effect means you accept the changes.

These Terms are governed by the laws of Malaysia, without regard to its conflict-of-laws rules, except where the mandatory consumer-protection laws of your country of residence require otherwise.

Binding arbitration. Any dispute, controversy, or claim arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the Singapore International Arbitration Centre (SIAC) under its Rules in force at the time. The seat of arbitration will be Singapore, the language will be English, and the tribunal will consist of a single arbitrator.

Class-action waiver. You and we each agree to bring disputes only on an individual basis. You waive any right to participate in a class, collective, or representative action.

Carve-outs.

• Either party may bring an individual action in small-claims court in your local jurisdiction.
• Where mandatory local consumer-protection law (including in the European Union and United Kingdom) gives you the right to sue in your home courts, that right is preserved.
• Either party may apply to any court of competent jurisdiction for injunctive or other equitable relief to protect its intellectual-property rights.

• Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Service.
• Severability. If any provision is held unenforceable, the remaining provisions will remain in full force.
• No waiver. A failure to enforce a provision is not a waiver of our right to enforce it later.
• Assignment. You may not assign these Terms without our written consent. We may assign these Terms to an affiliate or in connection with a corporate transaction.
• Notices. We may provide notices to you by in-app notification or email. You can reach us at hello@partypotapp.com.
• Force majeure. We are not liable for failures caused by events beyond our reasonable control.
• Language. These Terms are written in English. If we provide a translation, the English version prevails in case of conflict.

The pages on partypotapp.com/business describe services for event organisers, venues, and clubs, and are provided for information and lead-generation only. Any paid engagement for B2B services is governed by a separate signed agreement between your organisation and Advisory Apps Sdn Bhd — not by these Terms.
